RESIDENCE FOR PURCHASE OF PROPERTY IN SPAIN - LAST LAW REFORM - 2015

After two years of its entry into force, it just have been reformed the Law governing the ways of getting legal residence in Spain for foreign investors, specially, through the purchase of housing or property.

This reform wants facilitate access to housing and residence by foreigners who are interested in this questions and solve the problems and obstacles that have been observed with experience.

In SANZA SOLUCIONES we have been working on these issues since its inception and received countless inquiries, why publish this text to provide answers and facilitate the understanding of the home buying process and obtain legal residency for foreigners.


WHO CAN APPLY FOR RESIDENCE?


It is possible to apply for legal residency any foreign person who wants to buy a house or property in Spain for a minimum amount of 500,000 euros and fulfills essentially the following requirements:

1) Be at least 18 years.
2) No criminal record.
3) Not to be a person recorded as reprehensible in countries with which Spain has signed an agreement to that effect.
4) Having health insurance.
5) Have sufficient resources: monthly 2,130 euros (532 euros for each family member's residence if they are also required)

But in addition to the person who acquires the property, the residence can also get by the following family members:

- The spouse or person with similar relationship (partner)
- The minor children.
- The adult children if they are financially dependent on the purchaser and have not formed another household.
- The ancestors who are in charge of the purchaser.

Therefore, it is enough the investment for a person to benefit all same family members. The reform of the law alows the residence of some family members that was no previously possible: Partner, adult children and ancestors.


WHAT KIND OF PROPERTY IS NECESSARY TO BUY?


To get the residence, housing or property to buy must have the following conditions:

-          The value must be equal to or greater than 500,000 euros.
-          You can buy one or several properties; it is not necessary, therefore, that the investment is made in a single housing.
-          The purchase can be financed by mortgage, but it is always necessary that at least 500,000 euros are free of charges. So you can only fund what exceeding that amount.
-          The property can be rented; that is, the investor doesn’t need to live in the property.



RESIDENCE PERMIT


One of the most important innovations introduced reform of the law is that an foreing person who buy housing can directly apply for a residence permit, without the need to first obtain a residence visa as was the case previously. Thus significantly simplifying the formalities for residence permits.

The initial duration of the residence permit is two years but may be requested renewal is granted for five years. Provided that the conditions stated before the investment is maintained and remain, you can request unlimited renewals every five years. Not the "tax resident" in Spain is necessary for renewals; that is, the foreing person may be absent for more than six months a year while the Spanish territory without thereby losing their rights, as is the case with other types of residence permit.

The residence permit for investors authorize to work in Spain and free movement within Europe called "Schengen area" for three months in any six months.

Processing the residence permit is made directly in an Office of Spain, without it being necessary, therefore, the intervention of the corresponding Consulate and the resolution is very fast, within a maximum of twenty days; if the decision is not taken within this period, the request means estimated.


HOW TO BUY HOUSING AND GET THE RESIDENCE?


The process of buying a property in Spain that meets these requirements and get the corresponding residence permit is a process that can seem complex but if you have the means and resources is not a big problem.

The most common is that the person moves to Spain to see houses or property in which he is interested and prepare all necessary documentation in order to complete the process successfully. However, it is not even necessary to move abroad to complete the operation, for both, purchase and processing of the permit can be made by representative or attorney, though in this case it is necessary previusly to have a resident visa that apply in his Country. More and more often these procedures are carried out without displacement and with the new facilities provided by the reform of the Law, we understand this to be a common carry the process form.

RESIDENCIA POR COMPRA DE VIVIENDA EN ESPAÑA - ÚLTIMA REFORMA AÑO 2015

Tras dos años desde su entrada en vigor, acaba de reformarse la Ley que regula las formas de adquirir la residencia legal en España para inversores extranjeros, de forma señalada, por medio de la compra de vivienda o inmuebles.

Con esta reforma se pretende facilitar el acceso tanto a la vivienda como a la residencia por parte de aquellos extranjeros que estén interesados en ello y solventar los problemas y trabas que se han venido observando con la experiencia.

En SANZA SOLUCIONES venimos trabajando en estos asuntos desde sus comienzos y recibimos innumerables consultas, motivo por el cual publicamos este texto a fin de dar respuestas y facilitar la compresión del proceso de compra de vivienda y obtención de la residencia legal por personas extranjeras.


¿QUIÉN PUEDE SOLICITAR LA RESIDENCIA?

Puede solicitar la residencia legal todo aquel extranjero que quiera comprar una vivienda o inmueble en España por un importe mínimo de 500.000 euros y cumpla, en esencia, los siguientes requisitos:

1)      Ser mayor de 18 años.
2)      No tener antecedentes penales.
3)      No constar como persona rechazable en países con los que España tenga firmado convenio en tal sentido.
4)      Tener un seguro de enfermedad.
5)      Tener recursos económicos suficientes: 2.130 euros mensuales (más 532 euros más por cada miembro de su familia si también se pide la residencia para éstos)

Pero, además de la persona que adquiere la vivienda, también pueden conseguir la residencia los siguientes miembros de su familia:

-          El cónyuge o persona con análoga relación de afectividad (pareja de hecho)
-          Los hijos menores de edad.
-          Los hijos mayores de edad si dependen económicamente del adquirente y no han formado otra unidad familiar.
-          Los ascendientes que estén a cargo del adquirente.

Por tanto, es suficiente la inversión de una persona para que de la misma se beneficien los miembros de su familia. Con la reforma de la Ley se facilita la residencia de algunos familiares que antes no era posible: pareja de hecho, hijos mayores y ascendientes.


¿QUÉ VIVIENDA O INMUEBLE HAY QUE COMPRAR?

Para obtener la residencia, la vivienda o inmueble que se compre tiene que tener las siguientes condiciones:

-          El valor tiene que ser igual o superior a 500.000 euros.
-          Pueden comprarse uno a varios inmuebles; no es necesario, por tanto, que la inversión se haga en una sola vivienda.
-          La compra puede financiarse mediante hipoteca, pero siempre es necesario que al menos 500.000 euros estén libres de cargas. Por tanto se puede financiar solamente lo que exceda de dicha cantidad.
-          La vivienda o inmuebles pueden alquilarse; es decir, no es necesario que se empleen para vivir en ellos el inversor.



EL PERMISO DE RESIDENCIA

Una de las novedades más importantes que ha introducido la reforma de la Ley es que el extranjero que compre vivienda puede solicitar directamente el permiso o autorización de residencia, sin que sea necesario que previamente obtenga el visado de residencia como ocurría con anterioridad. Por tanto, se simplifican de forma importante los trámites para conseguir el permiso de residencia.

La duración inicial del permiso de residencia es de dos años pero puede solicitarse la renovación que se concede por cinco años. Siempre y cuando se mantengan las condiciones antes expresadas y se mantenga la inversión, puede solicitarse renovaciones ilimitadas de cinco en cinco años. No es necesaria la “residencia fiscal” en España para conseguir las renovaciones; es decir, que el extranjero puede ausentarse por tiempo superior a seis meses al año del territorio español sin que por ello pierda su derecho, como sí ocurre con otros tipos de permiso de residencia.

El permiso de residencia para inversores autoriza para poder trabajar en España y la libre circulación por Europa dentro del denominado “territorio Schengen” durante tres meses en cualquier período de seis meses.

La tramitación del permiso de residencia se hace directamente en una Oficina de España, sin que sea necesaria, por tanto, la intervención del Consulado correspondiente y la resolución es muy rápida, en un máximo de veinte días; si la decisión no se adopta en este plazo, la solicitud se entiende estimada.


¿CÓMO COMPRAR LA VIVIENDA Y OBTENER LA RESIDENCIA?

El proceso para comprar una vivienda en España que cumpla los requisitos mencionados y la obtención del correspondiente permiso de residencia es un proceso que puede parecer complejo pero que si se cuenta con los medios y recursos necesarios no supone mayor problema.

Lo más habitual es que la persona interesada se desplace a España para poder ver las viviendas o inmuebles en que esté interesado y preparar toda la documentación necesaria con el objeto de finalizar el proceso de forma satisfactoria. No obstante no es ni siquiera necesario que el extranjero se desplace para culminar la operación, pues tanto la compra como la tramitación del permiso se puede hacer mediante representante o apoderado, aunque en este caso sí necesitaría tener previamente un visado de residencia que se tramitaría en su país. Cada vez con mayor frecuencia se realizan estos trámites sin necesidad de desplazamiento y, con las nuevas facilidades aportadas por la reforma de la Ley, entendemos que va a ser ésta una forma habitual de llevar a cabo el proceso.
